Algemene Huurvoorwaarden Fietsen - Masteling Tweewielers

Artikel 1 – Definities

In deze voorwaarden wordt verstaan onder:

• Verhuurder: de partij die fietsen ter beschikking stelt.
• Huurder: de natuurlijke persoon of rechtspersoon die een huurovereenkomst aangaat.
• Fiets: iedere (elektrische) fiets, inclusief accessoires en onderdelen.
• Huurovereenkomst: de overeenkomst waarbij verhuurder een fiets aan huurder in gebruik geeft.

Artikel 2 – Toepasselijkheid

1. Deze voorwaarden gelden voor alle huurovereenkomsten.
2. Afwijkingen zijn alleen geldig indien schriftelijk overeengekomen.
3. Eventuele andere voorwaarden worden uitgesloten.

Artikel 3 – Aanbod en overeenkomst

1. Alle aanbiedingen zijn vrijblijvend.
2. De overeenkomst komt tot stand na bevestiging van de reservering.
3. Verhuurder kan een aanvraag weigeren.

Artikel 4 – Huurperiode

1. De huurperiode wordt vooraf overeengekomen.
2. De fiets dient uiterlijk op het afgesproken moment te worden ingeleverd.
3. Bij te late inlevering worden extra kosten in rekening gebracht.

Artikel 5 – Prijzen en betaling

1. Huurprijzen zijn inclusief btw, tenzij anders vermeld.
2. Betaling dient vooraf of bij aanvang te gebeuren.
3. Verhuurder kan een borg verlangen.

Artikel 6 – Borg

1. De borg dient als zekerheid voor verplichtingen van huurder.
2. Schade en kosten mogen hiermee worden verrekend.
3. Terugbetaling vindt plaats na controle van de fiets.

Artikel 7 – Staat van de fiets

1. De fiets wordt in goede staat geleverd.
2. Huurder controleert de fiets bij ontvangst.
3. Niet gemelde schade wordt geacht niet aanwezig te zijn bij aanvang.

Artikel 8 – Gebruik

1. De fiets dient normaal en zorgvuldig gebruikt te worden.
2. Verboden is onder andere:
• gebruik voor wedstrijden of commercieel gebruik
• gebruik onder invloed
• gebruik door derden zonder toestemming

Artikel 9 – Verplichtingen huurder

Huurder is verplicht:

• zorgvuldig met de fiets om te gaan
• de fiets goed af te sluiten, elektrische fietsen met het extra slot gezekerd aan de aarde af te sluiten
• schade en defecten direct te melden
• de fiets tijdig terug te brengen 

Artikel 10 – Schade

1. Huurder is aansprakelijk voor schade tijdens de huurperiode.
2. Ook schade door verkeerd gebruik valt hieronder.
3. De hoogte van de schade wordt door verhuurder vastgesteld.

 Artikel 11 – Diefstal

1. Bij diefstal moet huurder:
• direct de verhuurder inlichten
• direct aangifte doen
• sleutels en afneembare displays overleggen
• bewijs aanleveren
2. Bij nalatigheid is huurder volledig aansprakelijk.

 Artikel 12 – Onderhoud en reparatie

1. Onderhoud is voor rekening van verhuurder.
2. Reparaties alleen met toestemming.
3. Noodreparaties moeten direct gemeld worden.

 Artikel 13 – Pech

1. Bij pech dient huurder contact op te nemen.
2. Verhuurder zal waar mogelijk hulp bieden.

 Artikel 14 – Aansprakelijkheid huurder

1. Huurder is aansprakelijk voor:
• schade aan de fiets
• verlies of diefstal
• schade aan derden

 Artikel 15 – Aansprakelijkheid verhuurder

1. Verhuurder is niet aansprakelijk voor indirecte schade.
2. Aansprakelijkheid is beperkt tot directe schade door gebreken.

 Artikel 16 – Annulering

1. Annulering moet vooraf plaatsvinden.
2. Kosten bij annulering:
• 24–48 uur voor aanvang huur: 50% van de huursom
• <24 uur voor aanvang huur: 100% van de huursom
• no-show: 100% van de huursom
3. Inkorten van huur geeft geen recht op terugbetaling.

 Artikel 17 – Ontbinding

Verhuurder kan de overeenkomst beëindigen bij:

• overtreding van voorwaarden
• misbruik of onveilig gebruik

 Artikel 18 – Overmacht

Verhuurder is niet aansprakelijk bij overmacht, zoals:

• slecht weer
• storingen
• externe oorzaken

 Artikel 19 – Klachten

1. Klachten moeten zo snel mogelijk worden gemeld.
2. Partijen proberen samen een oplossing te vinden.

 Artikel 20 – Toepasselijk recht

1. Nederlands recht is van toepassing.
2. Geschillen worden behandeld door de bevoegde rechter.

Bij aanvang van de huurperiode dient een geldig legitimatiebewijs te worden getoond.

Als voor 1 dag gehuurd wordt is dat van 09.00 uur tot 18.00 uur

Het is niet toegestaan om met twee volwassenen op één fiets te rijden. Uitzonderingen hierop zijn onze duofiets, rolstoelstransportfiets en onze tandems. 

Specifieke voorwaarden en regels m.b.t. de huur van MTB's en racefietsen:

MTB's en racefietsen dienen voor 17.00 u te worden teruggebracht.

Het dragen van een fietshelm is verplicht.

MTB's mogen niet op het strand gebruikt worden.

In het bos-en duingebied van Schoorl kan het speciale MTB-parcours worden bereden. Buiten dit parcours mag men niet van het verharde wegdek afwijken.

In het PWN-gebied (een geldige dag- of jaarkaart is hier vereist) mag men tot 10.30 uur op de onderverharde paden fietsen, waar dit is toegestaan. Na deze tijd kunt u hiervoor een boete krijgen.

Article 1 – Definitions

In these terms, the following definitions apply:

• Lessor: the party providing the bicycle.
• Lessee: the individual or legal entity renting the bicycle.
• Bicycle: any (electric) bicycle, including accessories and components.
• Rental Agreement: the agreement under which the lessor provides a bicycle to the lessee.

 Article 2 – Applicability

1. These terms apply to all rental agreements.
2. Deviations are only valid if agreed in writing.
3. Any other terms and conditions are explicitly excluded.

 Article 3 – Offer and Agreement

1. All offers are non-binding.
2. The agreement is concluded upon confirmation of the reservation.
3. The lessor reserves the right to refuse a reservation without stating reasons.

 Article 4 – Rental Period

1. The rental period is agreed in advance.
2. The bicycle must be returned at the agreed time and location.
3. Late returns will result in additional charges.

 Article 5 – Prices and Payment

1. Rental prices include VAT unless stated otherwise.
2. Payment must be made in advance or at the start of the rental period.
3. The lessor may require a security deposit.

 Article 6 – Deposit

1. The deposit serves as security for compliance with the agreement.
2. The lessor may deduct damages or outstanding amounts from the deposit.
3. The remaining deposit will be refunded after inspection.

 Article 7 – Condition of the Bicycle

1. The bicycle is provided in good and safe condition.
2. The lessee must inspect the bicycle upon receipt.
3. Any defects not reported immediately are deemed not to have existed at the start.

 Article 8 – Use of the Bicycle

1. The bicycle must be used carefully and for its intended purpose only.
2. It is prohibited to:

• use the bicycle for racing or commercial purposes
• use the bicycle under the influence of alcohol or drugs
• allow third parties to use the bicycle without permission

 Article 9 – Obligations of the Lessee

The lessee must:

• handle the bicycle with due care
• always properly lock the bicycle, electric bicycles with the extra lock secured to the earth
• prevent damage and theft
• report damage or defects immediately
• return the bicycle on time

 Article 10 – Damage

1. The lessee is liable for any damage occurring during the rental period.
2. This includes damage caused by improper use.
3. The lessor determines the extent of the damage and associated costs.

 Article 11 – Theft

1. In case of theft, the lessee must:

• report the theft to the lessor and the police immediately
• provide the bicycle keys and the displays detachable
• submit an official police report

1. Failure to comply results in full liability for the replacement value.

 Article 12 – Maintenance and Repairs

1. Regular maintenance is the responsibility of the lessor.
2. Repairs require prior approval from the lessor.
3. Emergency repairs must be reported immediately.

 Article 13 – Breakdowns

1. In case of breakdown, the lessee must contact the lessor immediately.
2. The lessor will provide assistance where reasonably possible.

 Article 14 – Liability of the Lessee

1. The lessee is liable for:

• damage to the bicycle
• loss or theft
• damage caused to third parties

 Article 15 – Liability of the Lessor

1. The lessor is not liable for indirect or consequential damages.
2. Liability is limited to direct damage caused by proven defects.

 Article 16 – Cancellation

1. Cancellation must be made prior to the rental period.
2. The following cancellation fees apply:

• 24–48 hours before start: 50%
• less than 24 hours before start: 100%
• no-show: 100%

1. Shortening the rental period does not entitle the lessee to a refund.

 Article 17 – Termination

The lessor may terminate the agreement immediately in case of:

• violation of these terms
• misuse or unsafe use of the bicycle

 Article 18 – Force Majeure

The lessor is not liable for failure due to circumstances beyond control, including:

• severe weather conditions
• technical failures
• external disruptions

 Article 19 – Complaints

1. Complaints must be reported as soon as possible.
2. Parties will attempt to resolve disputes amicably.

 Article 20 – Governing Law

1. Dutch law applies to all agreements.
2. Disputes will be submitted to the competent court in the Netherlands.

A valid form of indentification must be shown at the start of the rental period.

If rented for 1 day, the rental period is from 09:00 to 18:00 h

It is not permitted to ride with two adults on one bicycle. Exceptions to this are our duo bike, tandem and wheelchair transport bike.

Specific conditions and rules regarding the rental of MTB's and road bikes:

MTB's and road bikes must be back before 17:00 h

Wearing a bicyle helmet is mandatory.

MTB's may not be used on the beach.

The special MTB-course can be ridden in the forest and dune area of Schoorl. Outside this course, one may not deviate frome the paved road surface.

In the PWN area (a valid day or annual pass is required here) one may cycle on unpaved paths until 10:30 h, where permitted. After this time, you may receive a fine for doing so.
